Terms of Service

Last updated: October 27, 2026·Effective: October 27, 2026

Summary

  • These terms are an agreement between you (or the organization you act for) and Catalizo Global Solutions, a company in the United States, which provides Catz Connect and Catz Mail.
  • Send only messages your recipients have agreed to or lawfully expect, honour every opt-out, and never use the Service for spam, phishing, malware or unlawful content. We may limit or suspend accounts that do.
  • Your content stays yours. You give us only the permission we need to run the Service for you.
  • WhatsApp, SMS, push and voice go through provider accounts you connect yourself; their terms and their charges apply. Our fees are those shown for your plan when you buy it, billed through Stripe.
  • The Service is provided without a service-level guarantee unless we agree one in writing, and our liability is limited as described below. Questions: developers@catalizo.com.

This summary is only an overview; the full text below is what applies.

1.The agreement

These Terms of Service ("Terms") govern your use of Catz Connect — the website, admin panel, API and SDKs, mail servers, the Catz Mail webmail and mobile app, and in-app calls (the "Service") — provided by Catalizo Global Solutions ("we", "us").

By creating an account, signing in or using the Service you accept these Terms. If you use the Service for an organization, you confirm that you may bind it, and "you" includes that organization (the "Customer"). Our Privacy Policy explains how we handle personal data.

2.The Service

Catz Connect lets organizations host business mailboxes on their own domains, send transactional and marketing email, send WhatsApp, SMS, push and voice messages, run in-app voice and video calls, and use all of this through an API and SDKs. Features and limits depend on the plan.

We may improve, change or remove features. If a change materially reduces a paid feature you rely on, we will tell you in advance where practical.

3.Accounts and eligibility

  • You must be at least 18 years old (or the age of majority where you live) and able to enter into a contract to create a panel account. The Service is not directed to children under 16.
  • Give accurate account information and keep it up to date.
  • Keep your sign-in methods secure — your email account, your authenticator app and your backup codes. You are responsible for activity under your account; tell us promptly at developers@catalizo.com if you suspect unauthorized use.

4.Organizations and their administrators

The owner and administrators of an organization control its settings, members, roles, mailboxes, domains, keys and connected providers. The Customer is responsible for:

  • the people it invites to the panel and the mailboxes it creates, and their compliance with these Terms;
  • giving its users and recipients any notices required by law, and answering their requests about data it controls (the panel provides export and erasure tools);
  • the configuration it chooses, such as tracking, retention periods and access rights.

5.Acceptable use

You must not use the Service, or let anyone use it, to:

  • send spam or other unsolicited bulk messages, or send marketing email, SMS, WhatsApp, push or voice messages without the consent or other lawful basis the applicable law and the provider's policies require;
  • ignore opt-outs — every unsubscribe, "STOP" reply and suppression must be honoured, and you must not re-add people who opted out without fresh consent;
  • send phishing, deceptive or impersonating messages, or forge headers, senders or caller ids;
  • distribute malware or links to it, or content that is unlawful, infringes the rights of others, harasses, threatens or exploits anyone, or sexualises minors;
  • use purchased, rented or scraped address or phone lists;
  • probe, overload or attack the Service or other networks, circumvent rate limits, quotas or security measures, or use our relay (TURN) servers or mail servers for anything other than the Service's own traffic;
  • resell or provide the Service to third parties in a way your plan does not allow, or use it to build a competing service from our non-public materials;
  • break any applicable law, including anti-spam, telemarketing, data protection and export laws.

6.Limits, monitoring and suspension

To protect recipients and the reputation of our network, the Service applies rate limits and plan limits, checks bounce and complaint rates, maintains suppression lists and may block senders, domains or destinations.

We may limit, pause or suspend an account, an organization, a key or a single channel, without prior notice where needed, if we reasonably believe that it breaches these Terms, harms the Service or others, creates legal risk, or is the subject of a valid complaint or legal request. We will tell you the reason where we lawfully can, and restore access once the problem is fixed. Repeated or serious breaches may lead to termination.

7.Your content

"Customer Content" means everything you or your users put into or send through the Service — mail, messages, templates, contacts, files and data. You keep all rights in it.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, process and display Customer Content only as needed to provide, secure and support the Service for you, and as the law requires. We handle personal data in Customer Content as your processor, as described in the Privacy Policy.

You are responsible for your Customer Content and confirm you have the rights and, where needed, the consents to use it with the Service.

8.Third-party providers

Several channels run on accounts you hold with other companies: for example Meta (WhatsApp Business Platform), SMS gateways (such as Twilio, Vonage, Plivo, Sinch, Infobip, Telnyx or Amazon SNS), Firebase for push notifications, and voice or video providers. For these:

  • you contract with the provider directly and must follow its terms and policies (for WhatsApp, including Meta's Business and Commerce policies and opt-in rules);
  • the provider bills you directly for its charges, which are separate from our fees;
  • we are not responsible for the provider's services, availability, decisions (for example template approvals, number blocks or account restrictions) or changes.

Payments for our fees are processed by Stripe under Stripe's terms.

9.Fees and billing

  • Fees are as shown on the pricing page or for your plan at the time of purchase. Paid plans are billed in advance through Stripe and renew automatically each billing period until you cancel.
  • Use above your plan's included allowance (overage) is metered and billed at the plan's rates, in arrears.
  • If a plan offers a free trial, the trial length and what happens at its end are shown when you start it.
  • Fees do not include taxes. You are responsible for applicable taxes, which may be added to your invoice.
  • If a payment fails, the organization may fall back to the limits of the free plan, and we may suspend paid features until the payment is made.
  • You can cancel at any time in the panel, either at the end of the current billing period or immediately; overage already used in the period is still invoiced. Fees already paid are not refundable, except where the law requires a refund.
  • We may change fees for future billing periods with at least 30 days' notice. If you do not agree, you can cancel before the change takes effect.

10.API keys and SDKs

  • API keys act on behalf of your organization. Keep them secret, store them only on servers you control (never in public code or apps), and rotate or revoke a key at once if it may have leaked. You are responsible for all use of your keys.
  • Use the API within the documented limits; we may change or retire API versions with reasonable notice.
  • Our official SDKs are published under the ISC License stated in each SDK's LICENSE file. That licence governs the SDK code itself; your use of the Service through it is governed by these Terms.

11.Availability and support

We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted or error-free. Maintenance, provider outages and events outside our control may affect it. There is no service-level agreement (SLA) or service credit unless we agree one with you separately in writing.

Email deliverability also depends on recipients' providers, your domains' DNS and your sending practices, which we do not control.

12.Termination and data export

  • You may stop using the Service at any time, cancel your plan and delete your organizations in the panel.
  • We may terminate these Terms or an account for a material or repeated breach, for non-payment, or if we stop providing the Service, with notice where practical.
  • Before you leave, export what you need: the panel offers an organization export and mailbox exports (mbox), and mailbox users can use standard mail protocols. After termination we delete or anonymise Customer Content as described in the Privacy Policy, except where we must keep it by law.
  • Sections that by their nature should survive termination (such as fees owed, disclaimers, limitation of liability, indemnity and governing law) survive.

13.Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that messages will be delivered, read or acted on by any recipient or provider.

14.Limitation of liability

To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, arising out of or relating to these Terms or the Service, even if advised of the possibility.

To the extent permitted by law, our total liability for all claims arising out of or relating to these Terms or the Service is limited to the greater of the amounts you paid us for the Service in the 12 months before the event giving rise to the claim, or US$100.

These limits do not apply to liability that cannot be limited by law, such as for fraud, gross negligence or wilful misconduct where the law so provides, or to your payment obligations and indemnity.

15.Indemnity

You will defend and indemnify Catalizo Global Solutions and its personnel against third-party claims, and the resulting losses, damages, fines and reasonable costs, arising from your Customer Content, your messages and sending practices, your use of third-party providers, or your breach of these Terms or of the law. We will tell you promptly about the claim and let you control its defence, and you will not settle it in a way that imposes obligations on us without our consent.

16.Governing law and disputes

These Terms are governed by the laws of the United States and of the State in which Catalizo Global Solutions is organized, without regard to conflict-of-law rules. The courts of that State have jurisdiction over disputes arising out of or relating to these Terms or the Service.

If you are a consumer, you keep any rights and protections that the law of your country of residence gives you and that cannot be waived by contract, including the right to bring proceedings in your local courts where that law provides it.

17.Changes and general terms

  • We may update these Terms. We will post the new version here with a new date and, for material changes, tell account holders by email or in the panel at least 30 days before they take effect. Continued use after that date means you accept the updated Terms; if you do not agree, stop using the Service and cancel your plan.
  • If any provision is found unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver.
  • You may not transfer these Terms without our consent; we may transfer them to a successor of our business.
  • These Terms, together with any written agreement we sign with you and the documents referred to here, are the entire agreement about the Service.
  • These Terms are available in several languages. If a translation differs from the English version, the English version governs.
